The magistrate agreed to move Setka’s hearing by five weeks, at the request of Setka’s lawyer.
The adjournment means that Setka has temporarily avoided entering a plea of guilty or not guilty, and will now have an extra five weeks to prepare his case.
Setka also had his bail extended to the next hearing date on February 13.
Senior Constable Prosecutor Eva Semertzidis told the court that the prosecution would not oppose the request for an adjournment because they needed to obtain further materials and make inquiries with the Altona North police officer who originally charged Setka on Boxing Day.
A CFMEU spokesperson declined to comment on whether the union was paying Setka’s legal fees in his criminal case.
The case is adjourned to February 13.
